Extension into common area

I live in a downstairs one bedroom flat with a shared front door. The new neighbour upstairs wants to extend his flat into the common hallway to build an extra bedroom. I asked to see a copy of the builders plans for the work, he said there isn't any. He says he doesn't need planning permission, is this correct? How do I stop him?
