Selling House with Tenant

Is there a way of selling a house with a sitting tenant? The current tenant has just signed a 12 month Shorthold tenancy ending Aug 2018. Do I have to wait until the tenancy ends to sell the house or can the contract be transferred to another Landlord. Is this possible, please?

  • I've had different answers to this, from different solicitors over the years. Some insist that you cannot exchange contracts without vacant possession, others don't. If you have a preferred solicitor, it is best to have a chat with them first. If you don't, speak with the agent that you're thinking of selling with to see if they have one that they could recommend. As far as I am aware, it is possible to sell a property with a tenant in place. The agency in which I work has done it several times, and the 'Landlord' changes the second it is completed. It is best practice to issue a new tenancy agreement immediately, so some pre-planning is essential. I'm not a solicitor, and therefore would always advise speaking with them before taking any steps as per my first paragraph.

  • No problem at all selling with tenants in place. Estate agents generally can't or won't market such properties, as they either don't get it or want to carry out viewings which are in some cases not possible. In other cases the Landlord may not want the tenant to know until the sale has completed. Good luck.

  • Hello - yes, it is entirely possible to sell with a sitting tenant although you are likely to attract investors only which means the offer price may be lower (depending on the return). If you were to wait until August you may achieve a better price, although it's hard to tell without knowing more about the property. All the best.
